Biographical Note
The case began with an action by the Indiana Attorney General on behalf of the State of
Indiana against the appellants and the appellee, Governor Henry F. Schricker. The
action sought to enjoin the defendants from acting or functioning under certain Acts of
the 82nd General Assembly, which proscribed the reorganization of various State
boards and commissions. A temporary injunction was issued enjoining the defendants
from interfering with or obstructing officers and appointees who currently managed state
agencies, boards and commissions in discharge with their duties under other laws or
from reorganizing or appointing new officers to state agencies, boards and commissions
as proscribed by the Acts in question. Secretary of State James M. Tucker and others
named filed an appeal with the Marion County Circuit Court, which upheld the
temporary injunction. The case was then appealed to the Indiana Supreme Court, which
also affirmed the trial court’s decision. The request for a rehearing was denied July 11,
1941.
